 DATES: The “DolEx & Elektra 2022 Mother’s Day Sweepstakes” (the “Sweepstakes”) begins at 12:00 a.m. Central Standard Time (“CST”) on May 1, 2022 and ends at 11:59 p.m. CST on May 31st, 2022 (the “Sweepstakes Period”). For purposes of these Official Rules, all times are given in CST. The date and time stamp from the Website (defined below) will be the “official computer” and official time keeping device for this Sweepstakes.

ELIGIBILITY: The Sweepstakes is open to residents of the United States who reside in the state of Alabama, Arizona, California, Colorado, Connecticut, Delaware, Georgia, Idaho, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Jersey, North Carolina, Oklahoma, Oregon, Pennsylvania, Puerto Rico, South Carolina, Tennessee, Texas, US Virgin Islands, Utah, Virginia, Washington or Wisconsin, and are eighteen (18) years of age or older (or the age of majority in their respective jurisdiction of residence) at the time of entry (each, an “Entrant”). The Entrants who are selected as the potential grand prize winner (“Grand Prize Winner”), first prize winners (each, a “First Prize Winner”), second prize winners (each, a “Second Prize Winner”), and third prize winners (each, a “Third Prize Winner”) must each have a unique, personal and valid social security number or ITIN for Sponsor (defined below) to report the tax liability associated with acceptance of the respective prize. Valid social security numbers/ITINs will be determined by Internal Revenue Service (“IRS”) requirements as further defined in the “PRIZE CLAIMS” section of these Official Rules. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in the same household, whether related or not) of DolEx Dollar Express, Inc.(the “Sponsor”), and each of their respective parent companies, divisions, affiliates, subsidiaries, distributors, advertising and agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes (all of the aforementioned collectively referred to as the “Sweepstakes Entities”), are not eligible to participate. The Sweepstakes is subject to all federal, state, and local laws and regulations and is void outside the states of Alabama, Arizona, California, Colorado, Connecticut, Delaware, Georgia, Idaho, Illinois, Indiana, Kansas, Kentucky, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Jersey, North Carolina, Oklahoma, Oregon, Pennsylvania, Puerto Rico, South Carolina, Tennessee, Texas, US Virgin Islands, Utah, Virginia, Washington, and Wisconsin and wherever else restricted or prohibited by law. By entering this Sweepstakes, Entrants indicate their full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsor and/or Independent Administrator, which are final and binding in all respects. Winning a prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: There are two (2) ways to receive entries into the Sweepstakes; (a) by making a money transfer as described below (the “Money Transfer”); or (b) without making a Money Transfer (the “Alternate Method of Entry” or “AMOE”). Entrants may enter via either of the entry methods listed below.  Regardless of the entry method(s) used to obtain entry into this Sweepstakes, there is a total limit of twenty-five (25) entries per person for the entire Sweepstakes Period.

Perform a Money Transfer: Entrants who perform a money transfer transaction to Mexico at either; (a) a DolEx branch located in the United States; or (b) via a DolEx independent agent (located in the United States) via the correspondents Elektra or Banco Azteca, will automatically receive one (1) entry into the Sweepstakes upon completing the Money Transfer.  Instructions for completing a Money Transfer are available at DolEx branches and / or via the independent agent chosen (Call 1-800-892-0210 for a list of DolEx branches and/or independent agents).

• AMOE:Entrants who wish to earn entry into the Sweepstakes without making a Money Transfer may do so as follows: On a plain 3” x 5” card, legibly handprint or type your first name, last name, address, city, state, zip code, telephone number you can be reached for potential prize winning notifications (including area code), date of birth and email address. Then, mail your completed 3” x 5” card to: “DolEx & Elektra 2022 Mother’s Day Sweepstakes”, 1595 Peachtree Parkway, Suite 204-266, Cumming, GA 30041.  Mail entries must be postmarked by May 31^st, 2022 and received by June 6,2022 to be considered eligible.  Limit of twenty-five (25) envelopes per Entrant. Each envelope is considered one (1) entry into this Sweepstakes. Multiple entries submitted by a single Entrant in the same envelope or exceeding the entry limit above will not be considered eligible. Entries submitted or completed by anyone other than the Entrant are void. No mechanical reproductions will be accepted.  Sponsor will not verify receipt of entries for Entries.  All entries submitted by mail become the sole property of the Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible, or damaged mailed entries.

Regardless of the method(s) of entry used to participate in this Sweepstakes, either Money Transfer, the AMOE or a combination of the two (2) entry methods, the maximum number of entries allowed per Entrant is twenty-five (25). In the event of a dispute regarding the identity of the person who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder (defined below) of the email address associated with the DolEx account (if the entry was received via Money Transfer) or the e-mail address connected with the email account submitted via the AMOE postcard. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by the Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An Entrant may be requested to provide Sponsor with proof that the Entrant is the Authorized Account Holder of the email address associated with the entry. Any attempt by any Entrant to enter this Sweepstakes using multiple/different accounts or any other methods may void the Entrant’s entries and may result in disqualification, at the sole discretion of Sponsor. Use of any automated system to participate in the Sweepstakes is prohibited and may result in disqualification. The Sweepstakes Entities are not responsible for any entry that is lost, late, misdirected or  undeliverable, whether due to system errors, omissions, interruptions, deletions, defects, delays in operation or transmissions or any other reason, theft or destruction or failures, faulty transmissions or other telecommunication malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. Late entries or entries sent via any other method than those stated above will not be accepted.

WINNING/NOTIFICATION:  On or about June 7, 2022, one (1) Grand Prize Winner, two (2) First Prize Winners, four (4) Second Prize Winners; ten (10) Third Prize Winners; and twenty (20) fourth prize winners (each, a “Fourth Prize Winner”) will be selected from among all eligible entries received during the Sweepstakes Period. The random drawing will be conducted by the Sponsor whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. Odds of being selected as a prize winner are dependent upon the total number of entries received during the Sweepstakes Period. The potential prize winners will be notified by the Sponsor via email within one (1) to three (3) business days from the date in which the random drawing takes place. Potential Grand, First, Second and Third Prize winners will be required to complete the prize claims and verification process as further described in the “PRIZE CLAIMS” section below. Sponsor will only make two (2) attempts to reach a potential prize winner via telephone giving prize winner seventy-two (72) hours to respond for each attempt. Potential prize-winning notifications will not be left on answering machines. In the event the Sponsor cannot reach a potential prize winner after two (2) attempts have been made by telephone, the original potential prize winner will be disqualified and an alternate prize winner (selected randomly as outlined above) will be notified until all prize winners are confirmed). Prize Winners consent (and agree to sign any additional documents required by Sponsor, to formalize, effect or perfect such consent, except where prohibited by law) for Sponsor and those acting under their authority, to use his/her name, likeness (photograph and/or video), biographical information, and voice in advertising/publicity/trade without territorial or time limitations and without compensation, notice or approval; and, the prize winners disclaim any ownership rights of such advertising/publicity/trade material.

 PRIZES: The total approximate retail value (“ARV”) of all prizes to be awarded in this Sweepstakes is $50,000.  The prizes are broken down as follows:

 Grand Prize: The Grand Prize Winner will receive one (1) prize of $10,000 cash, awarded in the form of a check (the “Grand Prize”).  The ARV of the Grand Prize is $10,000. Only one (1) Grand Prize will be awarded in this Sweepstakes.

 First Prizes: Each First Prize Winner will receive one (1) prize of $5,000 cash, awarded in the form of a check (each, a “First Prize”).  The ARV of each First Prize is $5,000.  A total of two (2) First Prizes will be awarded in this Sweepstakes.  The total ARV of all First Prizes to be awarded is $10,000.

 Second Prizes: Each Second Prize Winner will receive one (1) prize of $2,500 cash, awarded in the form of a check (each, a “Second Prize”).  The ARV of each Second Prize is $2,500.  A total of four (4) Second Prizes will be awarded in this Sweepstakes.  The total ARV of all Second Prizes to be awarded is $10,000.

 Third Prizes: Each Third Prize Winner will receive one (1) prize of $1,000 cash, awarded in the form of a check (each, a “Third Prize”).  The ARV of each Third Prize is $1,000.  A total of ten (10) Third Prizes will be awarded in this Sweepstakes.  The total ARV of all Third Prizes to be awarded is $10,000.

 Fourth Prizes: Each Fourth Prize Winner will receive one (1) prize of $500 cash, awarded in the form of a check (each, a “Fourth Prize”).  The ARV of each Fourth Prize is $500.  A total of twenty (20) Fourth Prizes will be awarded in this Sweepstakes.  The total ARV of all Fourth Prizes to be awarded is $10,000.

Prize winners cannot assign or transfer the prize to another person.  No prize substitution or cash alternative allowed except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or any portion thereof) with a prize of comparable or greater value, in their sole discretion. The value associated with the prizes are taxable as income and the prize winners are each solely responsible for any taxes, including, but not limited to, all applicable federal, state and local taxes that become due with respect to the value of the prize received and the tax year for which the prize is awarded. The Sponsor, or a third party acting on its behalf, is required to report the value of the prize to the Internal Revenue Service in the year the prize is received by a prize winner; and the value of the prize will be reported to the prize winner and the Internal Revenue Service in the form of a Form 1099 and/or other applicable tax forms. There is a limit of one (1) prize per person/household. Except as otherwise set forth herein, all prizes will be awarded.

PRIZE CLAIMS:  Except where prohibited, each potential Grand, First, Second and Third Prize Winner will be required to complete, execute and return an Affidavit of Eligibility, Liability and Publicity Release (the “Release”) and an IRS Form W-9 (“W-9 Form”) and any other documents required by Sponsor, (collectively, the “Required Documents”) within seven (7) days or less from receipt of Notification from the Sponsor by email. If a potential prize winner fails to return the Required Documents within the time period required, or if the email is returned as undeliverable, such potential prize winner forfeits his/her right to the prize and an alternate will be notified as outlined in the “WINNING/NOTIFICATION” section above, even if the disqualified potential prize winner’s name may have been publicly announced.  Potential prize winners must each report income to the IRS.  In the event it is deemed during the verification process that a potential prize winner does not have a unique, personal and valid social security number/ITIN for Sponsor to report the tax liability associated with acceptance of the prize, such potential prize winner will be disqualified, and an alternate will be notified as outlined above. Valid social security numbers/ITINs will be determined by IRS requirements. If it is determined by the Sponsor, in its sole discretion, that a potential prize winner is not eligible or otherwise not in compliance with these Official Rules, the potential prize winner forfeits his/her right to the prize and an alternate will be notified as outlined in the “WINNING/NOTIFICATION” section above, even if the disqualified potential prize winner’s name may have been publicly announced. In the event a potential prize winner is disqualified for any reason, Sponsor/Independent Administrator shall have no liability or obligation to such individual.

GENERAL RULES OF PARTICIPATION: By participating in this Sweepstakes, Entrants and prize winners [a] release each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or  described) with respect to or  arising out of  participation in the Sweepstakes, and/or the receipt or use/misuse of the prize awarded, including, without limitation, liability for personal injury, death or property damage; and [b] agree to be bound by these Official Rules and the decisions of the Sponsor/Independent Administrator, which are final in all respects and not subject to appeal. Sponsor reserves the right permanently to disqualify from this Sweepstakes any Entrant or prize winner it believes has violated these Official Rules. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Sweepstakes Entities.  If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the prize winners in a fair and equitable manner consistent with these Official Rules. Notification of such action will be provided on the Website. To the fullest extent permitted by law, Entrants covenant not to sue any Sweepstakes Entity or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit or rescind any releases. A waiver by one or more of the Sweepstakes Entities of any term in these Official Rules does not constitute a waiver of any other provision. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

NO LIABILITY: By participating, Entrants and prize winners each agree to release, discharge, indemnify and hold  harmless  the  Sponsor, and  the  Sweepstakes  Entities,  and  each  of  their respective officers, directors, employees, representatives and agents from and against any claims made by a prize winner, Entrants, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from  receipt, acceptance, possession, misuse or use of a prize; participation in any Sweepstakes-related activity; or participation in this Sweepstakes.

DISPUTES: Entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or a prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, an Entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules (whether of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Texas.

PRIVACY:  The collection of personal information provided in connection with this Sweepstakes will be used in accordance with Sponsor’s privacy policy.  Entrants may view the Sponsor’s privacy policy at any time by visiting https://www.dolex.com/legals/#privacypolicy

WINNER’S LIST REQUEST: For the name of the prize winners or a copy of these Official Rules, please submit a self-addressed, stamped envelope by February 28, 2022 to “Sorteo del día de las Madres DolEx & Elektra 2022”, to the SPONSOR.

Independientemente del método o métodos de participación utilizados para participar en este Sorteo, ya sea Transferencia de dinero, MAP o una combinación de los dos (2) métodos de participación, el número máximo de inscripciones permitidas por Participante es veinticinco (25). En el caso de una disputa con respecto a la identidad de la persona que envió una entrada, la entrada se considerará enviada por el titular de la cuenta autorizado (definido a continuación) de la dirección de correo electrónico asociada con la cuenta DolEx (si la entrada se recibió mediante transferencia de dinero) o la dirección de correo electrónico relacionada con la cuenta de correo electrónico enviada a través de la postal MAP. “Titular de cuenta autorizado” se define como la persona física a la que el proveedor de acceso a Internet, el proveedor de servicios en línea u otra organización (por ejemplo, empresa, institución educativa, etc.) que es responsable de asignar las direcciones de correo electrónico del dominio asociado con la dirección del correo electrónico del titular. Se puede solicitar al Participante que proporcione al Patrocinador una prueba de que el Participante es el Titular de la cuenta autorizado de la dirección de correo electrónico asociada con la participación. Cualquier intento de cualquier Participante de participar en este Sorteo usando cuentas múltiples / diferentes o cualquier otro método puede anular las inscripciones del Participante y puede resultar en la descalificación, a la sola discreción del Patrocinador. El uso de cualquier sistema automatizado para participar en el Sorteo está prohibido y puede resultar en la descalificación. Las Entidades del Sorteo no son responsables de ninguna participación que se pierda, se retrase, se envíe mal o no se pueda entregar, ya sea debido a errores del sistema, omisiones, interrupciones, eliminaciones, defectos, demoras en la operación o transmisiones o cualquier otra razón, robo o destrucción o fallas, defectuosas. transmisiones u otras fallas de telecomunicaciones, entradas no recibidas como resultado de fallas de hardware o software de cualquier tipo, conexiones de red perdidas o no disponibles, transmisiones informáticas o telefónicas fallidas, incompletas o distorsionadas, errores y fallas tipográficas o del sistema, fallas técnicas o de otro tipo. No se aceptarán participaciones tardías o enviadas a través de cualquier otro método que no sea el indicado anteriormente.

 GANADORES / NOTIFICACIÓN: El 7 de junio de 2022 o alrededor de esa fecha, un (1) Ganador del Gran Premio, dos (2) Ganadores del Primer Premio, cuatro (4) Ganadores del Segundo Premio; diez (10) ganadores del tercer premio; y veinte (20) ganadores del cuarto premio (cada uno, un “Ganador del cuarto premio”) serán seleccionados de entre todas las participaciones elegibles recibidas durante el Período del Sorteo. El sorteo al azar será realizado por el Patrocinador cuyas decisiones se basan en su sola discreción e interpretación de estas Reglas Oficiales y son definitivas y vinculantes en todos los aspectos. Las probabilidades de ser seleccionado como ganador del premio dependen del número total de inscripciones recibidas durante el Período del Sorteo. El Patrocinador notificará a los posibles ganadores del premio por correo electrónico en un plazo de uno (1) a tres (3) días hábiles a partir de la fecha en que se realice el sorteo al azar. Los posibles ganadores del Gran, Primer, Segundo y Tercer Premio deberán completar el proceso de verificación y reclamo del premio, como se describe más adelante en la sección “RECLAMOS DEL PREMIO”. El Patrocinador solo hará dos (2) intentos para comunicarse con un posible ganador del premio por teléfono, dándole al ganador del premio setenta y dos (72) horas para responder por cada intento. Las posibles notificaciones de premios no se dejarán en los contestadores automáticos. En caso de que el Patrocinador no pueda comunicarse con un posible ganador del premio después de que se hayan realizado dos (2) intentos por teléfono, el posible ganador original del premio será descalificado y se notificará a un ganador alternativo del premio (seleccionado al azar como se describe anteriormente) hasta que todos los ganadores del premio están confirmados. Los ganadores del premio están de acuerdo (y aceptan firmar cualquier documento adicional requerido por el Patrocinador, para formalizar, efectuar o perfeccionar dicho consentimiento, excepto donde lo prohíba la ley) que el Patrocinador y aquellos que actúen bajo su autoridad, utilicen su nombre, semejanza (fotografía y / o video), información biográfica y voz en publicidad / comercio sin limitaciones territoriales o de tiempo y sin compensación, aviso o aprobación; y los ganadores del premio renuncian a cualquier derecho de propiedad de dicho material publicitario / comercial.

PREMIOS: El valor comercial total aproximado (“VCA”) de todos los premios que se otorgarán en este Sorteo es de $ 50,000 USD. Los premios se desglosan de la siguiente manera:

• Gran Premio: El ganador del Gran Premio recibirá un (1) premio de $ 10,000 USD en efectivo, otorgado en forma de cheque (el “Gran Premio”). El VCA del Gran Premio es de $ 10,000 USD. Solo se otorgará un (1) Gran Premio en este Sorteo.
•  Primeros premios: cada ganador del primer premio recibirá un (1) premio de $ 5,000 USD en efectivo, otorgado en forma de cheque (cada uno, un “primer premio”). El VCA de cada primer premio es de $ 5,000 USD. | Se otorgarán un total de dos (2) primeros premios en este sorteo. El VCA total de todos los primeros premios que se otorgarán es de $ 10,000 USD.
• Segundos premios: cada ganador del segundo premio recibirá un (1) premio de $ 2,500 USD en efectivo, otorgado en forma de cheque (cada uno, un “segundo premio”). El VCA de cada segundo premio es de $ 2,500 USD. Se otorgarán un total de cuatro (4) Segundos Premios en este Sorteo. El VCA total de todos los segundos premios que se otorgarán es de $ 10,000 USD.
• Terceros premios: cada ganador del tercer premio recibirá un (1) premio de $ 1,000 USD en efectivo, otorgado en forma de cheque (cada uno, un “tercer premio”). El VCA de cada tercer premio es de $ 1,000 USD. Se otorgarán un total de diez (10) Terceros Premios en este Sorteo. El VCA total de todos los Terceros Premios que se otorgarán es de $ 10,000 USD.
• Cuarto premio: cada cuarto ganador del premio recibirá un (1) premio de $ 500 USD en efectivo, otorgado en forma de cheque (cada uno, un “cuarto premio”). El VCA de cada cuarto premio es de $ 500 USD. Se otorgará un total de veinte (20) Cuarto Premios en este Sorteo. El VCA total de todos los Cuartos Premios que se otorgarán es de $ 10,000 USD.

Los ganadores del premio no pueden ceder ni transferir el premio a otra persona. No se permite la sustitución del premio ni la alternativa en efectivo, excepto a discreción exclusiva del Patrocinador, quien se reserva el derecho de sustituir un premio (o cualquier parte del mismo) por un premio de valor comparable o mayor, a su entera discreción. El valor asociado con los premios está sujeto a impuestos como un ingreso y los ganadores del premio son los únicos responsables de los impuestos, incluidos, entre otros, todos los impuestos federales, estatales y locales aplicables con respecto al valor del premio recibido y el año fiscal en el que se otorga el premio. El Patrocinador, o un tercero que actúe en su nombre, debe informar el valor del premio al Servicio de Impuestos Internos en el año en que el ganador del premio recibe el premio; y el valor del premio se informará al ganador del premio y al Servicio de Impuestos Internos en forma de un Formulario 1099 y / u otros formularios de impuestos aplicables. Hay un límite de un (1) premio por persona / hogar. Salvo que se establezca lo contrario en este documento, se otorgarán todos los premios.

RECLAMACIONES DE PREMIOS: Excepto donde esté prohibido, cada posible ganador del Gran, Primer, Segundo y Tercer Premio deberá completar, ejecutar y devolver una Declaración Jurada de Elegibilidad, Responsabilidad y Exención de Publicidad (la “Exención”) y un Formulario W-9 del IRS ( “Formulario W-9”) y cualquier otro documento requerido por el Patrocinador, (colectivamente, los “Documentos Requeridos”) dentro de los siete (7) días o menos desde la recepción de la Notificación del Patrocinador por correo electrónico. Si un posible ganador del premio no devuelve los Documentos requeridos dentro del período de tiempo requerido, o si el correo electrónico se devuelve como imposible de entregar, dicho posible ganador del premio perderá su derecho al premio y se notificará a un suplente como se indica en la sección “GANAR / NOTIFICACIÓN” en la sección anterior, incluso si el nombre del posible ganador del premio descalificado puede haber sido anunciado públicamente. Los posibles ganadores del premio deben informar cada uno de sus ingresos al IRS. En caso de que se considere durante el proceso de verificación que un posible ganador del premio no tiene un número de seguro social / ITIN único, personal y válido para que el Patrocinador informe la obligación tributaria asociada con la aceptación del premio, dicho posible ganador del premio será descalificado, y se notificará a un suplente como se describe anteriormente. Los números de seguro social / ITIN válidos serán determinados por los requisitos del IRS. Si el Patrocinador determina, a su sola discreción, que un posible ganador del premio no es elegible o no cumple con estas Reglas Oficiales, el posible ganador del premio pierde su derecho al premio y se notificará a un suplente como descrito en la sección “GANAR / NOTIFICACIÓN” anterior, incluso si el nombre del posible ganador del premio descalificado puede haber sido anunciado públicamente. En el caso de que un posible ganador del premio sea descalificado por cualquier motivo, el Patrocinador / Administrador Independiente no tendrá ninguna responsabilidad u obligación con dicha persona.

REGLAS GENERALES DE PARTICIPACIÓN: Al participar en este Sorteo, los Participantes y los ganadores del premio [a] liberan a todas y cada una de las Entidades del Sorteo, de toda responsabilidad, daños o causas de acción (sin importar su nombre o descripción) con respecto o como consecuencia de la participación en el Sorteo y / o la recepción o uso / mal uso del premio otorgado, incluyendo, sin limitación, responsabilidad por lesiones personales, muerte o daños a la propiedad; y [b] acepta estar sujeto a estas Reglas Oficiales y las decisiones del Patrocinador / Administrador Independiente, que son definitivas en todos los aspectos y no están sujetas a apelación. Si por alguna razón este Sorteo no se puede llevar a cabo según lo planeado, incluidos, entre otros, debido a una infección por virus informáticos, errores, manipulación, intervención no autorizada, fraude o cualquier otra causa más allá del control razonable del Patrocinador que corrompa o afectar la administración, seguridad, imparcialidad, integridad o conducción adecuada del Sorteo, entonces el Patrocinador se reserva el derecho, a su entera discreción, de cancelar, terminar, modificar o suspender el Sorteo y seleccionar a los ganadores del premio de una manera justa y equitativa consistente con estos Reglas Oficiales. La notificación de dicha acción se proporcionará en el sitio web. En la mayor medida permitida por la ley, los Participantes se comprometen a no demandar a ninguna Entidad del Sorteo ni a demandarlos con respecto a cualquier asunto divulgado anteriormente; y un convenio adicional de no negar, limitar o rescindir cualquier declaración. Una renuncia por parte de una o más de las Entidades del Sorteo de cualquier término de estas Reglas Oficiales no constituye una renuncia a ninguna otra disposición. PRECAUCIÓN: CUALQUIER INTENTO DE UNA PERSONA DE DAÑAR O QUEBRANTAR DELIBERADAMENTE EL FUNCIONAMIENTO LEGÍTIMO DEL SORTEO PUEDE INCURRIR EN VIOLACIÓN DE LAS LEYES PENALES Y CIVILES Y, EN CASO DE QUE SE REALICE DICHO INTENTO, EL PATROCINADOR SE RESERVA EL DERECHO A BUCAR SOLUCIONES PARA RESARCIR LOS DAÑOS (INCLUYENDO HONORARIOS DE LOS ABOGADOS) DESDE CUALQUIER PERSONA HASTA EL GRADO MÁXIMO DE LA LEY, INCLUYENDO EL PROCESO PENAL. EL INCUMPLIMIENTO DEL PATROCINADOR DE CUALQUIER TÉRMINO DE ESTAS REGLAS OFICIALES NO CONSTITUIRÁ UNA RENUNCIA A ESTAS DISPOSICIONES.

RESPONSABILIDAD NULA: Al participar, los Participantes y los ganadores del premio acuerdan liberar, relevar, indemnizar y eximir de responsabilidad al Patrocinador y a las Entidades del Sorteo, y a cada uno de sus respectivos funcionarios, directores, empleados, representantes y agentes, de y contra cualquier reclamo realizado por un ganador del premio, Participantes o cualquier otro tercero, relacionado de alguna manera con el funcionamiento de este Sorteo, así como cualquier otro reclamo, daño o responsabilidad debido a lesiones, daños o pérdidas de cualquier persona (incluida la muerte) o propiedad de cualquier tipo que resulte total o parcialmente, directa o indirectamente, de la recepción, aceptación, posesión, uso indebido o uso de un premio; participación en cualquier actividad relacionada con el Sorteo; o participación en este Sorteo.

CONTROVERSIAS: Los participantes acuerdan que todas y cada una de las disputas, reclamos y causas de acción que surjan de, o estén relacionadas con, el Sorteo o un premio otorgado se resolverán individualmente, sin recurrir a ninguna forma de demanda colectiva, y exclusivamente por el tribunal correspondiente, ubicado en Texas. Todas las cuestiones y preguntas relacionadas con la construcción, validez, interpretación y aplicabilidad de estas Reglas Oficiales, los derechos y obligaciones del Participante, o los derechos y obligaciones del Patrocinador en relación con el Sorteo, se regirán e interpretarán de acuerdo con las leyes de Texas, sin dar efecto a ninguna elección de ley o reglas de conflicto de leyes (ya sea de Texas o de cualquier otra jurisdicción), lo que causaría la aplicación de las leyes de cualquier jurisdicción que no sea Texas.
